Right, Wrong or Somewhere In The Middle?

There will always be topics to debate: -
  • Shaving: Glove Up/ Not
  • Regulation: For/ Against
Add to that list, Barbershops offering alcohol as part of the service/ ambience FREE and this is where now find ourselves squarely in the middle or do we?

You may have read in the national press and in Modern Barber about a local council who has told a barbershop to stop providing alcohol. The problem here is local councils don’t appear to have a uniformed response to shops on the local high street. We continually argue that councils should be doing more, what with shops opening unchecked allowing untrained barbers on an unsuspected public, who have no idea on the basics let alone health & safety matters - sterilisation anyone. This is a nationwide problem and consistency as in refereeing in football is seriously lacking.

FACT: The Licensing Act 2003 covers licensable activities such as: -
  • the retail sale of alcohol or
  • supply of alcohol

FREE beer to customers falls under supply and it can be argued that the provision of beer constitutes part of the sale (hair cut). However, some councils appear to adopt a different attitude, hence the grey area or you’re left in the middle!

Our advice is to contact your council to seek clarification on whether a premises and personal licence is required. If the answer is Yes, apply and don’t get caught out.

So where does insurance fit? Well your barbershop policy should be able to include cover for Loss of Licence; the licence granted for the retail sale and supply of liquor at the premises/ shop. A monetary limit will cover the costs and expenses incurred to appeal the forfeiture of or refusal to renew the licence. The depreciation in value at the premises aspect is less relevant as the business model is a barbershop first and foremost and not a venue solely to provide alcohol - pub/ bar/ club. Needless to say terms/ conditions and exclusions apply.
